Overview of DRC Mining Licensing
Mining rights in the Democratic Republic of Congo are administered by CAMI (Cadastre Minier), the national mining registry. Under the 2018 Mining Code, the DRC operates a first-come, first-served licensing system — making speed and preparation critical.
Types of Mining Rights
| License Type | Duration | Area Limit | Purpose | |-------------|---------|------------|----------| | Permis de Recherche (PR) | 5 years (renewable) | Up to 400 km² | Exploration | | Permis d'Exploitation (PE) | 30 years (renewable) | Determined by feasibility study | Full production | | Permis d'Exploitation de Petite Mine (PEPM) | 10 years | Up to 50 km² | Small-scale production | | Autorisation d'Exploitation Artisanale (AEA) | Annual | Within ZEA zones | Artisanal mining |
Step-by-Step Application Process
Step 1: Company Incorporation
Foreign investors must incorporate a Congolese entity (SARL or SA) or joint-venture with a local partner. Minimum capital requirements apply.
Step 2: Prepare Technical Dossier
Required documents:
- Topographic map of the requested area
- Company registration documents
- Environmental baseline assessment
- Proof of technical capacity and financial resources
- Environmental bond guarantee
Step 3: Submit to CAMI
Applications are lodged at CAMI's Kinshasa office or via the online portal. A non-refundable application fee is paid at submission.
Step 4: CAMI Review
CAMI verifies availability of the area (no overlapping claims), assesses the dossier, and conducts an internal review. Typical timeline: 30–90 days.
Step 5: Environmental Approval
For PE licenses, the Agence Congolaise de l'Environnement (ACE) must approve the Environmental Impact Study (EIS). Timeline: 60–180 days.
Step 6: License Issuance
Upon approval, CAMI issues the license and enters it in the national register. Annual surface fees become payable.
Key Costs (Approximate)
| Cost Item | Amount | |-----------|--------| | PR application fee | USD 200/km² | | PE application fee | USD 500/km² | | Annual surface rent (PR) | USD 20/km² | | Annual surface rent (PE) | USD 80/km² | | Environmental bond | USD 100,000+ |
